(Tyler, TX) Two shocking arrests in East Texas are being reported by the Smith County Sheriff's Office where a mother and her son were taken into custody for injuring an infant in their care.

When we received the press release from Smith County Sheriff Larry Smith, he included a statement in the email that said: "These types of cases are always hard on the responding Deputies and Investigators. Thoughts and prayers for this infant."

On Wednesday, January 8, 2025, at approximately 6:00 pm a Smith County Deputy responded to UT Health in Tyler regarding a possible child abuse.

Once on scene, the Deputy contacted hospital personnel who informed him that a three-month old infant had received significant injuries which looked like child abuse. At the time, the infant was undergoing CT scans and X-Rays.

The attending Nurse informed the Deputy that the infant was lethargic, weak, and had bruises on the face and neck. A Smith County Crimes Against Children Investigator was notified and responded to the hospital. After observing the infant, the investigator was able to confirm the injuries himself.

The Investigator spoke with the attending ER Physician who explained that the infant had a broken right clavicle.

Also, the infant’s right arm had to be splinted to his chest for healing purposes.

The Investigator spoke with the infant’s mother who explained that her infant had just returned home after spending several days with his father, Zachray McGinn, at a residence located in the 8900 block of County Road 2192 near Whitehouse.

The mother explained that she had been in contact with both McGinn and McGinn’s mother, Brittany Mackey, on Facebook Messenger while her child was away. The mother further explained that on January 8, 2025, both McGinn and Mackey dropped off the infant at her residence.

It was at this time that the mother observed the lethargic manner of her child and the bruising to his face. Shortly thereafter, the mother took the infant to the UT Health Emergency Room in Tyler.

Mackey is the grandmother of the infant.

Investigators obtained a search warrant for their residence, and both Zachray McGinn and Brittany Mackey were detained and transported to the Sheriff’s Office. After questioning both individuals, a judge issued warrants on both McGinn and Mackey for the criminal offense of Injury to a Child (Second Degree Felony) with bonds being set at $250,000 each.

Both individuals were transported to the Smith County Jail and are presumed innocent until proven guilty.
