Watch Out They Are Coming For the Delta: These Products May Soon Be Illegal in Texas

When it comes to having laws, it's a must to have laws to keep the state running smoothly, however, some of these laws take away the choice of Texans.

Another law that Texans may soon face is the loss of cannabis products.

Marijuana is still illegal in Texas, however, some cannabis-based products are legal.  These products may go on the illegal list if Lt. Governor Dan Patrick and other Texas Senators have their say.

What is Delta-8 and Delta-9

Delta-8 is a product that is created using chemically synthesized cannabinoids, most of the time these products are unregulated and untested.   Delta-9 is a product produced from cannabinoids found in a cannabis plant.  Delta-9 is regulated and tested.

Governor Greg Abbott signed House Bill 1325 into law in 2019, also called the Hemp Farming Act. This law legalizes the manufacture, production, and retail sale of industrial hemp crops and products, as well as their inspection. However, these products must contain a THC level of 0.3% or less. The law also covers consumable hemp products that contain CBD (cannabidiol) and other edible parts of the hemp plant.

Lt. Governor Dan Patrick released a list on April 11, 2024, of 57 items he wants Texas Senators to consider before the 2025 Legislative session.  One of those 57 items is banning Delta-8 and 9:

Examine the sale of intoxicating hemp products in Texas. Make recommendations to further regulate the sale of these products, and suggest legislation to stop retailers who market these products to children.

According to a press release, the 57 items listed came from the 31 Texas Senators who talked with Texans about the changes they want to see.  A shortening of the list may occur before the 89th Legislature.

The ban of Delta 8 and 9 will unlikely be removed from that list.

The 89th Texas Legislature session won't begin until January 14, 2025, so if these products become banned, it will not go into effect until mid or late 2025 or possibly 2026.

If this does happen a lot of businesses will run the risk of closing.
