Is It Legal To Drink In Your Front Yard In Texas?

I've heard rumors that you aren't supposed to drink alcohol in your front yard in Texas, but if you drive down any given neighborhood, you're bound to find someone sitting mowing the grass with a beer in their hand. So, is it actually illegal to drink in your own front yard? Let's see what Texas law has to say about it...

Is it legal to drink in your own front yard?

According to TABC, there is actually no statewide ban that prohibits you from drinking in public, unless you are in a state park, or somewhere in a city where it is specifically deemed illegal. You can have all the beers you want on your front lawn, but when you start walking down the street with them, things could get a little trickier.

Apparently, you can't drink in public places on Sundays between 12:15 a.m. and noon, which is kind of weird. You also can't drink in public Monday through Friday between 12:15 a.m. and 7 a.m. However, you're free to drink in public between 10 a.m. and noon on Sundays if you are in a location that allows food and drink purchases, like a fair, a festival, a sports venue, or a concert.

So, if you're curious why the guy walking down the street with a 40 oz isn't in jail, I guess that's your answer. Public intoxication is, however, still very illegal. Even so,  you're probably safe to have a few beers in your yard in Texas, at least from what I can tell...feel free to correct me if I'm wrong!
