Legalizing marijuana in Texas has been a back-and-forth battle over the years, but as more states decriminalize the "devil's lettuce" the Lone Star State is making moves that seem to soften their stance against the drug.

Proposition R

This petition-driven proposition passed prohibiting Dallas officers from making arrests or issuing citations for marijuana possession under four ounces. What's more, officers can no longer use the odor of marijuana as probable cause for search and seizure unless it's part of a felony or high-priority investigation.

Does That Make The "Sticky Icky" Legal?

The short answer is no. Recreational use of marijuana is still illegal in the state of Texas. So you can't roll around in your car puffing away. However, if you do get caught with less than four ounces of ganja the chances of you getting some matching bracelets or a hefty fine has dramatically gone down.

Texas does recognize the medical benefits of marijuana with the Texas Compassionate Use Act passed in 2015. And, in 2019, Texas legalized the production, sale, and inspection of industrial hemp crops and products including CBD.

While the recreational use of marijuana remains illegal, this may be a huge step in legalizing "Mary Jane".

But with Texas Lt. Governor, Dan Patrick calling for the complete ban of all THC products, the marijuana tug-of-war continues.
